Welcome to BiteWise. By accessing or using our website and platform, you agree to be bound by these Terms and Conditions (“Terms”). Please read them carefully before using our services.
1. Acceptance of Terms
By creating an account, starting a free trial, or using any part of the BiteWise platform, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use our services.
2. Description of Service
BiteWise provides a smartphone-based food waste tracking platform that allows kitchen staff to scan QR codes, photograph food waste bins, and receive AI-generated waste analytics including estimated volume, weight, and food type. The platform is intended for use by food service businesses, restaurants, and commercial kitchens.
3. Account Registration
To access the BiteWise dashboard, you must register for an account. You agree to: Provide accurate and complete registration information; Keep your login credentials confidential; Notify us immediately of any unauthorized use of your account; Accept responsibility for all activity that occurs under your account.
4. Free Trial
BiteWise may offer a free trial period. At the end of the trial, continued use of the platform requires a paid subscription. We reserve the right to modify or discontinue free trial offers at any time.
5. Subscription and Payment
Subscriptions are billed on a recurring basis (monthly or annually) as selected at sign-up. All fees are non-refundable unless otherwise stated. We reserve the right to change pricing with reasonable notice. Failure to pay may result in suspension or termination of your account.
6. Acceptable Use
You agree not to: Use the platform for any unlawful purpose; Submit false, misleading, or inappropriate images or data; Attempt to reverse-engineer, hack, or disrupt the BiteWise system; Resell or sublicense access to the platform without written consent; Upload content that infringes on third-party intellectual property rights.
7. AI-Generated Data & Accuracy
BiteWise uses artificial intelligence to estimate waste volume, weight, and food type from photos. These estimates are provided for operational guidance only. BiteWise does not guarantee the accuracy of AI-generated data and is not liable for decisions made based on these estimates.
8. Intellectual Property
All content, software, logos, trademarks, and technology associated with BiteWise are the exclusive property of BiteWise and its licensors. You are granted a limited, non-exclusive, non-transferable license to use the platform solely for your internal business purposes.
9. Data Ownership
You retain ownership of the waste data submitted through your account. By using BiteWise, you grant us a limited license to process and analyze your data for the purpose of delivering our services and improving our AI systems, as described in our Privacy Policy.
10. Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during the course of using the platform, and not to disclose such information to third parties without prior written consent.
11. Termination
We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to other users, third parties, or BiteWise. You may cancel your account at any time through your dashboard settings.
12. Limitation of Liability
To the maximum extent permitted by applicable law, BiteWise shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the platform. Our total liability to you for any claim shall not exceed the amount you paid to BiteWise in the three months preceding the claim.
13. Disclaimer of Warranties
The BiteWise platform is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico and applicable federal laws of the United States, without regard to its conflict of law provisions.
15. Changes to These Terms
We may revise these Terms at any time. Continued use of the platform after changes are posted constitutes your acceptance of the revised Terms. We will notify users of material changes via email or a notice on our platform.
